If you die intestate (without making a Spanish will) DO NOT EXPECT YOUR PARTNER TO AUTOMATICALLY INHERIT YOUR HALF OF THE HOUSE! In Spain, if you die intestate the only thing you are guaranteed to leave to your nearest and dearest is a SERIOUS HEADACHE! You would not want to inflict this on the loved ones you leave behind, as so many of our clients who have already had to deal with this dreadful situation will testify.

If you have lost a family member or partner who owned a property in Spain their estate (or inheritance), known in Spain as an Herencia, needs to be finalized before it is possible to sell or to transfer the property.
